Terms of Service
This agreement governs your use of the PrimeLendings loan marketplace platform operated by Prime Lendings Loans LLC.
IMPORTANT NOTICE — PLEASE READ CAREFULLY
By accessing or using any part of the PrimeLendings platform, you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws. If you do not agree, do not use our services. Section 18 contains a binding arbitration clause and class action waiver that affects your legal rights.

1. Introduction & Company Identity
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Prime Lendings Loans LLC (“PrimeLendings,” “we,” “our,” or “us”), a limited liability company operating the online loan marketplace platform at primelendingsloans.com(the “Platform”).
Brand Clarification
PrimeLendings (primelendingsloans.com) is operated by Prime Lendings Loans LLC and is a loan marketplace for personal loans, payday loans, and cash advances. It is entirely separate from and unaffiliated with PrimeLending, A PlainsCapital Company (primelending.com), which is a mortgage company headquartered in Dallas, TX. The two companies share no ownership, employees, branding rights, or operational relationship.
PrimeLendings operates as an online loan marketplace and matching platform. We are licensed as required by applicable state and federal law and maintain relationships with a network of licensed lender partners. We are not a bank, credit union, or direct lender.
By creating an account, submitting a loan inquiry, clicking “Accept,” or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Eligibility Requirements
To use the PrimeLendings Platform, you must meet all of the following requirements at all times:
- Be at least 18 years of age (19 in Alabama and Nebraska; 21 in Puerto Rico)
- Be a legal resident or citizen of the United States
- Possess a valid Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN)
- Hold an active checking or savings account at a U.S. federally insured financial institution
- Have a verifiable source of regular income (employment, self-employment, benefits, or other lawful sources)
- Not be a debtor in an active bankruptcy case, or have had a bankruptcy discharged within the past 12 months (requirements may vary by lender)
- Not reside in a state where the requested loan type is prohibited by law
- Provide accurate, truthful, and complete information throughout all stages of the application process
PrimeLendings reserves the right to deny access to or suspend use of the Platform at its sole discretion based on compliance, fraud prevention, regulatory requirements, or any other lawful reason without prior notice.
Certain loan products (e.g., payday loans, home loans) may have additional eligibility requirements imposed by individual lenders. State availability varies — not all loan products are available in every state.
3. Nature of Our Services
3.1 Marketplace Role — We Are Not a Lender
PrimeLendings is a loan marketplace, lead generation platform, and financial comparison service. We are not a lender. We do not:
- Make credit decisions or approve or deny loan applications
- Set interest rates, APRs, origination fees, or any other loan terms
- Fund, disburse, or service loans
- Hold consumer deposits or act as a financial institution
Our role is limited to collecting your loan request and personal/financial information and transmitting it to one or more third-party lenders (“Lenders”) in our network for their independent review and credit decision.
3.2 Loan Products Facilitated
Through our Lender network, PrimeLendings may facilitate access to the following loan types (subject to state availability and individual lender criteria):
- Personal Loans (Unsecured) — $1,000 to $100,000
- Payday & Short-Term Loans — $100 to $5,000 (where legal)
- Cash Advances — Up to $5,000, same-day funding options
- Debt Consolidation Loans — $1,000 to $50,000
- Home Equity Loans & HELOCs — Up to $500,000
- Auto Loans & Refinancing
- Small Business Loans — $5,000 to $500,000
- Student Loan Refinancing
3.3 No Guarantee of Loan Approval or Specific Terms
Submitting a loan request through PrimeLendings does not guarantee that you will receive a loan offer, specific interest rate, or any particular loan amount. All approval decisions, rates, terms, and conditions are determined solely and independently by individual Lenders based on their proprietary underwriting criteria, your credit profile, and applicable law.
3.4 Free Service to Borrowers
Use of the PrimeLendings matching platform is free to borrowers. We are compensated by Lenders when we facilitate a successful loan matching. This compensation does not influence our matching process or the loan terms offered to you.
4. How the Matching Process Works
When you submit a loan request on PrimeLendings, the following process occurs:
- Form Submission: You provide personal, financial, and contact information through our secure online form.
- Soft Credit Check (Optional): We or our data partners may perform a soft credit inquiry to pre-qualify your request. This does not affect your credit score.
- Lender Matching: Your profile is compared against the criteria of Lenders in our network. We identify one or more potentially suitable Lenders.
- Data Transmission: Your information is transmitted to matched Lender(s), who conduct their own independent review.
- Lender Offer (if approved): If a Lender approves your application, they will present you directly with an offer containing specific rates, terms, fees, and repayment schedule — all as required by TILA. You are under no obligation to accept.
- Borrower Decision: You review, compare, and choose whether to accept any offer. We strongly encourage you to read all loan documents before signing.
PrimeLendings may share your information with multiple Lenders simultaneously. Receiving multiple offers allows you to compare and select the best terms for your situation.
5. User Accounts & Registration
When you create an account on PrimeLendings, you agree to:
- Provide accurate, current, and complete registration information
- Maintain and promptly update your account information to keep it accurate
- Keep your login credentials confidential and not share them with any third party
- Accept full responsibility for all activity that occurs under your account
- Notify PrimeLendings immediately of any unauthorized account access at security@primelendingsloans.com
One account per person is permitted. You may not create or use accounts on behalf of others without proper legal authorization (e.g., notarized power of attorney). Accounts are non-transferable. PrimeLendings reserves the right to suspend or permanently terminate accounts that violate these Terms, with or without notice.
6. Credit Inquiries & Authorization
By submitting a loan request through PrimeLendings, you expressly authorize PrimeLendings and its Lender partners to:
- Obtain your credit reports from one or more of the three major credit reporting agencies (Equifax, Experian, TransUnion) or specialty consumer reporting agencies
- Verify your identity, income, employment, and bank account information
- Retain your information in accordance with our Privacy Policy
6.1 Soft vs. Hard Inquiries
- Soft inquiry (rate check): Does not affect your credit score. Used for pre-qualification matching.
- Hard inquiry (formal application with a specific Lender): May temporarily affect your credit score. Disclosed by the Lender before submission.
- Multiple hard inquiries for the same loan type within a 30-day window are typically treated as a single inquiry by FICO and VantageScore scoring models.
6.2 Your FCRA Rights
Under the Fair Credit Reporting Act (FCRA), you have the right to:
- Obtain a free copy of your credit report from each bureau annually at annualcreditreport.com
- Dispute inaccurate, incomplete, or unverifiable information in your credit report directly with the relevant credit bureau
- Know when information in your credit report is used against you in a credit decision (adverse action notice)
- File a complaint with the Consumer Financial Protection Bureau (CFPB) at consumerfinance.gov
7. Loan Terms, Rates & Fees
PrimeLendings does not set or negotiate loan terms. All rates, fees, and conditions are determined independently by each Lender. Typical ranges in our network are provided below for informational purposes only — your actual terms will depend on your credit profile, loan type, loan amount, term length, and state of residence.

8. Electronic Communications & ESIGN Consent
By using PrimeLendings, you consent to receive all communications, agreements, notices, disclosures, and documents electronically (“Electronic Communications”) in accordance with the Electronic Signatures in Global and National Commerce Act (ESIGN) and applicable state law.
Electronic Communications include, but are not limited to:
- These Terms of Service and any amendments
- Our Privacy Policy
- Loan offers, pre-qualification notices, and adverse action notices
- Account statements and transaction confirmations
- Responses to your inquiries and complaints
To receive Electronic Communications, you need: a device with internet access, a current web browser, and an active email address. You may withdraw this consent at any time by contacting support@primelendingsloans.com; however, withdrawal may prevent you from using certain services.
9. Telephone & Text Message Consent (TCPA)
By providing your telephone number and submitting a loan request, you expressly consent under the Telephone Consumer Protection Act (TCPA) and applicable state law to receive:
- Autodialed or prerecorded telephone calls from PrimeLendings and its Lender partners regarding your loan inquiry
- Text messages (SMS/MMS) from PrimeLendings and its Lender partners regarding loan offers, application status, and account information
This consent is not a condition of purchase or receiving any services. Standard message and data rates may apply. Message frequency varies.
To opt out of text messages: Reply STOP to any text message from us. To opt out of calls: contact support@primelendingsloans.com or call +1-800-774-6356.
10. Information We Collect & How It Is Used
10.1 Categories of Information Collected
- Identity: Full legal name, date of birth, government-issued ID, SSN/ITIN
- Contact: Email address, phone number, mailing address, ZIP code
- Financial: Employment status, employer name, gross annual income, monthly housing costs, existing debts, requested loan amount and purpose, credit score range
- Banking: Bank account type, institution name (for lender matching; full account numbers transmitted to lenders only after your consent)
- Technical: IP address, browser type, device identifiers, operating system, pages visited, session duration, referring URL
- Communications: Content of messages you send us, call recordings (with notice), and survey responses
10.2 How We Use Your Information
- To match you with suitable Lenders in our network
- To verify your identity and prevent fraud and money laundering (KYC/AML compliance)
- To communicate with you about your loan request, account, and related financial products
- To comply with federal and state legal and regulatory obligations
- To improve, analyze, and personalize our Platform and services
- To conduct marketing and remarketing activities (subject to your consent preferences)

11. Information Sharing & Lead Generation Disclosure
Lead Generation Disclosure — Required by Federal Regulation
PrimeLendings operates as a loan lead generation marketplace. By submitting your information, you authorize PrimeLendings to share it with multiple Lender partners simultaneously for the purpose of presenting you with loan offers. You may receive direct communications from those Lenders.
By using the Platform, you expressly consent to PrimeLendings sharing your personal and financial information with:
- Licensed Lender partners in our marketplace network (for loan matching and origination)
- Credit reporting agencies — Equifax, Experian, TransUnion, and specialty bureaus (for soft and hard inquiries as described in Section 6)
- Identity verification and fraud prevention providers (e.g., Socure, Plaid, Experian RentBureau) to comply with KYC/AML obligations
- Analytics and marketing service providers who process data on our behalf under confidentiality obligations
- Government agencies, regulators, and law enforcement as required by applicable law, court order, or regulatory investigation
- Successor entities in the event of a merger, acquisition, or sale of assets
We do not sell your personal information to unaffiliated third parties for their own independent marketing purposes without your explicit prior consent.
12. Your Privacy Rights
12.1 California Residents (CCPA / CPRA)
California residents have the right to:
- Know what personal information we collect, use, disclose, and sell
- Delete personal information we hold about you (subject to legal exceptions)
- Correct inaccurate personal information
- Opt out of the “sale” or “sharing” of personal information
- Non-discrimination for exercising your privacy rights

12.2 Vermont Residents
Vermont law imposes additional restrictions on the sharing of financial information. PrimeLendings does not share financial information about Vermont residents with non-affiliated third parties for marketing purposes without affirmative consent.
12.3 All Users — GLBA Rights
Under the Gramm-Leach-Bliley Act (GLBA), you have the right to opt out of certain information sharing with non-affiliated third parties. To opt out, email privacy@primelendingsloans.com. Note that opting out of information sharing may prevent us from matching you with Lenders.
13. Regulatory Compliance
PrimeLendings and its Lender partners operate in compliance with the following federal and state consumer protection laws, among others:
Truth in Lending Act (TILA / Reg Z)
Requires full disclosure of APR, finance charge, and repayment terms before signing
Equal Credit Opportunity Act (ECOA / Reg B)
Prohibits discrimination in credit transactions based on race, color, religion, national origin, sex, age, or marital status
Fair Credit Reporting Act (FCRA)
Governs the use of consumer credit information and your rights to dispute inaccuracies
Gramm-Leach-Bliley Act (GLBA)
Requires us to safeguard consumer financial information and provide privacy notices
CAN-SPAM Act
Governs commercial email communications; you may opt out at any time
Telephone Consumer Protection Act (TCPA)
Governs automated calls and text messages; consent required
Electronic Fund Transfer Act (EFTA / Reg E)
Protects consumers using electronic fund transfer services
California Consumer Privacy Act (CCPA / CPRA)
Provides additional rights to California residents

PrimeLendings is registered with the Nationwide Multistate Licensing System (NMLS). Lender licenses can be verified at nmlsconsumeraccess.org.
14. Prohibited Uses
You agree not to use the PrimeLendings Platform to:
- Provide false, misleading, or fraudulent information in any loan application or account registration
- Apply for loans on behalf of another person without proper legal authorization
- Use loan proceeds for illegal activities, the purchase of illegal goods, or purposes prohibited by applicable law or lender agreement
- Circumvent, disable, or attempt to bypass our fraud detection, identity verification, or security systems
- Scrape, harvest, crawl, or systematically extract data, content, or user information from the Platform
- Reverse-engineer, decompile, disassemble, or attempt to extract source code or algorithms from our systems
- Transmit malware, viruses, ransomware, spyware, or any other harmful or disruptive code
- Impersonate PrimeLendings, a Lender partner, or any other person or entity
- Use the Platform for any purpose that violates these Terms, applicable law, or the rights of any third party
- Access or use the Platform from a jurisdiction where our services are prohibited
Violation of these prohibitions may result in immediate account termination, referral to law enforcement, and civil or criminal liability. PrimeLendings cooperates fully with law enforcement investigations of fraudulent applications.
15. Disclaimers & Limitation of Liability
15.1 No Financial or Legal Advice
Nothing on the PrimeLendings Platform constitutes financial, legal, tax, or investment advice. All content is provided for informational purposes only. You are solely responsible for evaluating whether any loan product is appropriate for your financial situation. We strongly encourage you to consult a licensed financial advisor, attorney, or credit counselor before taking on debt obligations.
15.2 Third-Party Lenders Are Independent
PrimeLendings is not responsible for the actions, omissions, products, services, or content of any Lender in our network. Each Lender is an independent company governed by its own terms and licenses. Any dispute about a loan you obtain through our platform must be resolved directly with that Lender.
15.3 Platform Provided “As-Is”
THE PRIMELENDIGS PLATFORM IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
15.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRIMELENDIGS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM OR ANY LOAN PRODUCT OBTAINED THROUGH IT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO PRIMELENDIGS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
Some jurisdictions do not allow certain exclusions or limitations of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
16. Indemnification
You agree to defend, indemnify, and hold harmless PrimeLendings, its affiliates, licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Platform; (c) any information you submit, post, or transmit through the Platform; or (d) your violation of any third-party rights, including any intellectual property, privacy, or proprietary rights.
17. Intellectual Property
The PrimeLendings Platform, including all content, features, functionality, design, software, text, graphics, logos, and trademarks, is owned by Prime Lendings Loans LLC or its licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial loan matching purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any portion of the Platform without our express prior written consent.
18. Dispute Resolution & Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
This section contains a binding arbitration clause and a class action waiver. By agreeing to these Terms, you waive your right to a jury trial and to participate in a class action lawsuit.
18.1 Informal Resolution First
Before initiating any formal dispute, you agree to contact us at disputes@primelendingsloans.com with a written description of your claim and the relief requested. We will respond within 30 days. Most concerns can be resolved at this stage.
18.2 Binding Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or your use of the Platform shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as provided in Section 18.4.
The arbitration shall be conducted in English, and any in-person hearings shall take place in the county of your residence. The arbitrator shall have authority to award any relief that a court could award, subject to the limitations in Section 15.4.
18.3 Class Action Waiver
YOU AND PRIMELENDIGS EACH AGREE THAT ANY PROCEEDINGS TO RESOLVE CLAIMS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
18.4 Exceptions to Arbitration
The following claims are excluded from arbitration:
- Claims that qualify for small claims court in your jurisdiction
- Claims for injunctive or other equitable relief to prevent unauthorized use or misappropriation of intellectual property
- Governmental enforcement actions
18.5 Opt-Out Right
You may opt out of this arbitration agreement by sending written notice to legal@primelendingsloans.com within 30 days of first agreeing to these Terms. Your opt-out notice must include your full name, mailing address, and account email. Opting out will not affect any other terms.
19. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. For matters not subject to arbitration (including equity claims or small claims), you consent to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware.
20. Changes to These Terms
PrimeLendings reserves the right to modify these Terms at any time. We will notify you of material changes by:
- Sending an email to your registered email address at least 30 days before the change takes effect
- Posting a prominent notice on the Platform homepage
- Updating the “Effective Date” and “Version” at the top of this document
Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Platform and close your account.
Non-material changes (e.g., typographical corrections, formatting updates) may be made without prior notice.
